UP Government Stops Compounding of Illegal Construction.  – Amar Ujala Hindi News Live

Following the order of the High Court, the State Government has banned compounding of construction in urban areas that is contrary to the approved map. Additional Chief Secretary Housing Nitin Ramesh Gokarn has issued a government order in this regard and sent instructions to the vice-chairmen of the Development Authority.

Allahabad High Court has given this decision on March 13 in Brij Mohan Tavanr vs. State Government. The High Court has said that there should not be more construction on the spot than the approved map. It has also been ordered that no construction should be done beyond the standards prescribed in the building construction and development bye-laws. Along with this, even in cases of mitigation, the standards set under building construction and development bye-laws should not be relaxed. The construction which is not permitted by the building construction and development bye-laws should not be permitted through mitigation.

Additional Chief Secretary Housing has said in the government order issued that the order passed by the High Court will be strictly followed. It should be ensured that construction work is carried out at the site as per the approved maps. In case of construction taking place outside the approved map, building construction and development bye-laws, fixed rules, government orders and rules will be strictly followed against such constructions.

The map is passed by the development authorities on the basis of building development bye-laws issued by the Housing Department. Even after this, construction is carried out contrary to the plans passed by the building owners. The government comes up with a policy for compounding from time to time by charging fees for such construction. On this basis illegal constructions are made legal. The High Court has expressed strong objection to this. A ban has been imposed on this basis.
